Execution of public service is expression of special trust from society and the state and makes great demands of moral ethically shape of public servants.
Society counts that the public servant will put all the forces, knowledge and experience in the professional activity which is carried out by it, impartially and honestly to serve the Homeland - the Republic of Kazakhstan.
Public servants in their activity should be adhere to the policy of the First President of the Republic of Kazakhstan - Leader of the nation N. Nazarbayev and gradually to enforce it.
The Code of honor of public servants of Republic of Kazakhstan (Rules of service ethics of public servants) as consistent with Constitution of the RoK, Laws of Republic of Kazakhstan from July 23, 1999 “About public servants”, the Law of Republic of Kazakhstan from July 2, 1998 “About anticorruption efforts” and common moral-ethic norms sets the main standards of behave of public servants of Republic of Kazakhstan.
Code is directed for strengthening of trust of the society to the public bodies, formation od high culture of interrelations on the public service and prevention of cases of non ethic behavior of the public servants.
Heads of state bodies , central executive bodies - executive secretaries of central executive bodies or public officials who are clothed with authority of executive secretaries of central executive bodies in accordance with the established procedure or shown officials – heads of central executive bodies provides the execution of requests of this Code in the building of public bodies, places which are accessible for general viewing.
Public servants must be introduced to this Code in written form during the three days after receive by public office.
Common rules of behavior
Public servants have:
- to promote strengthening of unity of the people of Kazakhstan and international consent in the country, validly to relate to state and to other languages, traditions and customs of the people of Kazakhstan.
- to be honor, fair, low-key, to respect the standard moral ethical standards, to show politeness and a correctness when communicating with citizens and colleague.
- to provide legitimacy and fairness of decisions he makes;
- to provide clarity of making decisions touching rights and legal interests of physical and juridical bodies;
- to resist to the actions causing harm to the interests of the state interfering effective functioning of government bodies;
- to improve their professional level and coalification for effective use in duty of service;
- not to give a reason for reasonable criticism from society, not to allow prosecution for criticism, to use constructive criticism for elimination of shortcomings and improvement of the activity;
- not to use employment status in order to influence activity of state bodies, organizations, public servants and other persons at the solution of questions of personal character;
- not to spread information not corresponding to the reality;
- to provide the safe of state property, rationally, effectively and only in business purpose to use the entrusted state ownership including vehicle;
- rigorously respect the state and labor discipline, effectively to dispose of the conferred powers, conscientious, impartial and qualitatively to fulfill the official duties, rationally to use working time;
- on the permanent basis to take measures on increase of quality of the provided public services, entirely orienting on requests of population as consumers of public services;
- not to allow in relation to the subordinated workers of unreasonable charges, the facts of roughness, humiliation of human dignity, tactlessness, incorrect behavior;
- to adhere to an official style in clothes during execution of the official duties;
Appearance of public servant while execution of his public responsibilities have to promote strengthening of the authority of public administration, to correpond to general accepted business style which distinguished by officiality, restrain and accuracy.
The public servants must not use employment status and capacity relevant to them on behalf of social and religion association and other non-profit organizations, including for promotion of the attitude towards them.
The public servants holding senior positions can't force the subordinated workers to participation in activity of public and religious associations, other non-profit organizations.
Behavior standards of public servants in off-duty time
Public servants in off-duty time have:
- to adhere to the general accepted moral and ethical standards, not allow cases of antisocial behavior, including being in public places in drunken state, harming human reputation and general accepted morality;
- to show modesty, not emphasize and not use official capacity while receiving corresponding services;
- not to allow from oneself violation of requirements of law associated with offense against general accepted morality, order and security, and not to involve other citizens in commitment illegal, anti-public actions.
Behavior standards in work relationships
Public servants in work relationships with colleagues must:
- to encourage establishment and strengthening of business and kind relationships between colleagues;
- to suppress or take other measures on exclusion violation of service ethic norms;
- to keep from discussion of private and professional qualities of colleagues disreputing their honor and value in the team;
- not to allow actions (misactions) preventing execution of colleagues' official duties.
Heads in relation to subordinates:
- with their behavior to be an example of fairness, justice, self-neglect, respectful relation to the honor and value of personality;
- to provide adhering of meritocracy principles, while decision of personnel questions not to provide preferences by kinship, fraternity and personal allegience signs;
- to show fairness and objectivity while assessment of their capacity results, and taking measures of encouragment and punishment;
- to take measures directed to labor, health protection, creation of favorable moral and pshycological atmosphere exclusing any forms of discrimination and disrepution of servants' honor and value;
- not to use duty position for influence on their activity while deciding the questions of non-service character;
- not to force making illegal actions, and actions not complying with general accepted moral and ethic standards;
- not to allow non-grounded prosecutions, rudeness, indignity, indelicacy and incorrect behavior.
Public servants held lower positions must:
- to present only objective and reliable information while execution of heads' orders;
- to inform quickly heads and ethics agent on became known cases of violation of service ethic standards and disciplinary offences, discrediting public service;
- not to allow actions (misactions) preventing execution of legal orders of the head;
- not to allow display of personal allegiance, aspiration to receipt of profits and advantages at the cost of job opportunities.
Behavior standards related to public speech including mass media
Public speech concerning activity of government body are carried out by his head or officials of government body authorized on it.
The public servants should make discussion in correct form, without undermining authority of public service.
The public servants shouldn't publicly express the opinion concerning a state policy and office activity, if it:
- is not corresponded to the main directions of policy of the state;
- opens office information which isn't allowed for publication;
- contains unethical statements to officials of the state, state bodies, other public servants.
Publications by public servants on behalf of government body on the questions which aren't connected with carrying out a state policy, activity of government body and public servants aren't allowed. The publication of materials on pedagogical, scientific and other creative activity can be carried out by the public servant only from own name as individual.
At presentation to the public servant of unreasonable public charge of corruption he has to take from the date of detection of such charge measures for its denial in a month.
In order to publicize new ethical rules for civil servants Agency for Civil Service Affairs developed a mobile application ‘Ethics in civil service’. The mobile application provides the text of the Code of Ethics, information on commissioners for ethics, recommendations for civil servants on form of clothing, testing to determine ethics, as well as gifts reminder.
Also, the Agency developed a pocket book "Ethics and Standards of Conduct for Civil Servants", which provides a brief guide for civil servants based on situational examples. In addition, this manual presents key aspects of the formation of a culture of integrity of civil servants. Following this instruction will contribute to the acquisition by society and citizens of confidence in the honesty and impartiality of men and women serving the people.
