Registration of labor relations

The first step will be registration of labor relations with the employer that is conclusion of labor contract. Labor contract – is a written agreement between employer and candidate according to which he undertakes to give certain work to the worker, to provide labor conditions and timely in full amount to pay salary, and the worker undertakes to perform this work and observe rules of the internal labor schedule of the organization.
Labor contract (LC) made in duplicate and each of which is signed by both parties. One copy provided to you, another kept by the employer.
Necessary document for conclusion ILC:
- identity card or passport (certificate of birth for the persons who have not reached age under sixteen);
- residence permit or certificate of stateless person (for foreigners and stateless persons constantly living in the territory of the Republic of Kazakhstan;
- document about education, qualification, availability of special skills or professional training at the labor contract conclusion for work requiring appropriate knowledge and skills;
- document confirming labor activity (for those who having seniority);
- document on passage of preliminary medical examination (for those who must undergo such examination in accordance with present Code and legislation of the Republic of Kazakhstan);
The employer has no right to demand documents that are not provided for by paragraph 1 of article 32 of the Labour Code of the RK, except for the cases provided for by laws and other normative legal acts of the Republic of Kazakhstan.
- right to rest (break during the working day, weekends and holidays);
- right to annual paid labor vacation lasting not less than 24 calendar days;
- right to paid vacation on pregnancy and childbirth, vacation without preserving salary on child care, up to 3 years;
- right to social benefits on temporary disability (in case of illness);
- right to terminate labor contract, having warned about it the employer in writing not less than 1 month;
- right to compensation in case of downsizing number or working staff.
Termination of labor relations
If you, for whatever reason, decided to retire from the work, you need to know about your rights and responsibilities. As labor contract is a transaction, termination of labor relations described by legislation of the RK. The labor contract can be terminated under the agreement of parties, at the initiative of the employer or the worker.
In this case, the party of the labor contract which has expressed desire to terminate the labor contract under the agreement of parties directs notification to other party of the labor contract. The part which has received notification, obliged within three working days in writing form to inform to other part about accepted decision. Under the agreement with the worker in the labor contract can be provided the right of the employer to termination of the labor contract without observance of given requirements, with compensation in amount not less than the average salary for year. In a day of labor contract termination the employer obliged to issue employment history or other document, confirming labor activity of the worker.
At the request of the worker (including former) the employer obliged within five working days from the moment of address to issue inquiry indicating specialty (qualifications, posts), an operating time and amount of salary, characteristic-recommendation containing data on qualification of the worker and his attitude to work and so forth.
At liquidation, bankruptcy, termination of activity the employer obliged in presence of debt owed to the worker to issue properly executed inquiry on amount of formed indebtedness on salary and other payments.
